Mintz member Jacob Hupart spoke with Agenda about the continued push for Scope 3 greenhouse gas emissions disclosure requirements under the SEC’s proposed climate rule, despite continued corporate pushback and potential change in Congress. Jacob commented: “The question of what should or should not be included in Scope 3 disclosures is a tricky one, it is difficult to clearly and consistently determine where the dividing line should be when ‘we engage in such relationships.” He continued: “A number of regulators are proposing Scope 3 emissions disclosure requirements, with the understanding that some proposed regulations may need to be dropped as part of the negotiation process before implementation, the inclusion of Disclosure of Scope 3 GHG emissions in their proposals can be a useful bargaining chip for regulators.”
